Kim Agri Nexus ("we", "us", "our", "the Platform") is committed to protecting your privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use our website, mobile application, IoT sensor services, and related services. Please read this Privacy Policy carefully. By using the Platform, you consent to the data practices described in this policy.
We collect several types of information from and about users of our Platform:
Personal Information: When you register for an account, we collect personal information including: full name, phone number, email address, physical address, farm location (county, sub-county, village), farm size, crops grown, and national ID number (for financing applications only).
Farm Data: If you participate in our IoT sensor program, we collect soil moisture levels, temperature readings, humidity data, crop growth metrics, irrigation history, and yield data. This data is collected from sensors placed on your farm with your consent.
Usage Data: We automatically collect information about how you interact with our Platform, including pages visited, time spent, features used, search queries, and click patterns.
Device Data: We collect information about your device including IP address, browser type, operating system, device identifiers, and mobile network information.
Transaction Data: If you use our Market Hub, we collect information about products listed, prices, quantities sold, buyer information, and transaction history.
Communication Data: We collect information from your communications with us, including emails, phone calls, WhatsApp messages, and support tickets.
We collect information through: registration forms and account creation; IoT sensors installed on your farm (with your explicit consent); automatic collection technologies (cookies, web beacons, log files); communications with our support team; third-party partners (banks, financing institutions, with your consent); surveys and feedback forms; and publicly available sources.
We use your information to: provide, operate, and maintain the Platform; generate AI crop predictions, weather forecasts, and pest alerts; improve our AI models and recommendation accuracy; connect you with buyers through the Market Hub; facilitate financing applications (with your consent); send you important notifications about weather, pests, and market prices; respond to your inquiries and provide customer support; analyze usage patterns to improve user experience; prevent fraud and ensure platform security; comply with legal obligations; and communicate about updates, promotions, and partnership opportunities (with opt-out option).
We DO NOT sell your personal information to third parties. We may share your information in the following limited circumstances:
Service Providers: We share data with trusted service providers who help us operate the Platform (cloud hosting, data analytics, customer support). These providers are contractually obligated to protect your data and use it only for specified purposes.
Financing Partners: With your explicit consent, we share relevant information with banks and lenders to process loan applications. This includes farm size, crop history, and revenue data.
Market Hub Buyers: When you list products on our marketplace, certain information (location, crop type, quantity, price) is visible to potential buyers. Your personal contact information is only shared when you accept a transaction.
Aggregated Data: We share anonymized, aggregated data with research institutions, government agencies, and development partners for agricultural research, policy-making, and impact measurement. This data cannot be used to identify you personally.
Legal Requirements: We may disclose information if required by law, court order, or government regulation.
Business Transfers: In the event of a merger, acquisition, or asset sale, your information may be transferred. We will notify you of any such change.
We implement reasonable physical, technical, and administrative security measures to protect your information. These include: encryption of data in transit (SSL/TLS), encryption of sensitive data at rest, access controls and authentication protocols, regular security audits and vulnerability assessments, employee training on data protection, and incident response procedures. However, no internet transmission or electronic storage is 100% secure. While we strive to protect your data, we cannot guarantee absolute security.
We retain your personal information for as long as your account is active or as needed to provide services. We may retain certain information after account closure for legal compliance, fraud prevention, and legitimate business purposes (e.g., aggregated analytics, dispute resolution). IoT sensor data is retained for up to 5 years to train our AI models. You may request deletion of your data at any time (subject to legal retention requirements).
You have the following rights regarding your personal information:
Access: You may request access to the personal information we hold about you.
Correction: You may request correction of inaccurate or incomplete information.
Deletion: You may request deletion of your personal information (subject to legal exceptions).
Opt-out: You may opt out of marketing communications at any time by clicking "unsubscribe" in emails or contacting us directly.
Data Portability: You may request a copy of your data in a machine-readable format.
Consent Withdrawal: You may withdraw consent for IoT sensor data collection at any time (sensors will be removed within 30 days).

Participation in our IoT sensor program is voluntary and requires your explicit written or verbal consent. You may withdraw consent at any time. If you withdraw consent, we will remove sensors from your farm within 30 days and stop collecting new data. Data collected before withdrawal may be retained in anonymized, aggregated form for research purposes. You retain ownership of raw sensor data and may request a copy or deletion.
We use cookies and similar tracking technologies to improve user experience, analyze usage patterns, and serve relevant content. You may disable cookies in your browser settings, but some Platform features may not function properly. Types of cookies we use: essential cookies (required for Platform operation), preference cookies (remember your settings), analytics cookies (understand usage patterns), and marketing cookies (limited to on-platform promotions).
The Platform is not intended for children under 13 years of age. We do not knowingly collect personal information from children under 13. If we learn we have collected such information, we will delete it promptly. By using the Platform, you represent that you are at least 13 years old. For registration, you must be at least 18 years old to create an account.
The Platform may contain links to third-party websites (banks, financing partners, government portals). We are not responsible for the privacy practices or content of these third parties. We encourage you to read their privacy policies before providing any personal information.
Your information may be transferred to and stored on servers located outside Kenya (cloud infrastructure provided by Microsoft Azure). We ensure appropriate safeguards are in place, including standard contractual clauses approved by relevant data protection authorities. By using the Platform, you consent to such transfers.
We may update this Privacy Policy from time to time to reflect changes in our practices or legal requirements. We will notify you of material changes by posting a notice on the Platform or sending an email. The "Last updated" date at the top of this page indicates when changes were made. Your continued use of the Platform after such changes constitutes your acceptance of the updated Privacy Policy.
